Please read these terms carefully before using the MedySoar platform. By using our services, you agree to these legally binding terms.
1Acceptance & Use of Services
Your use of the Platforms is subject to these TOS, which may be updated by MedySoar from time to time without notice. The Services are designed to assist medical practitioners (“Doctors”) and lab professionals (“Pathologists”) to store and review Patient Data.
We do not guarantee that the Platforms will be available uninterrupted or error-free. MedySoar is not responsible for interruptions due to network failures or technical incidents at the user's end. We reserve the right to modify pricing, features, or discontinue services at any time.
2Registration & Account Security
You are responsible for maintaining the confidentiality of your username and password. MedySoar will not be liable for losses arising from unauthorized access to your account.
Professional Representation: Doctors and Pathologists represent that they are licensed professionals with valid registrations (e.g., MCI/NMC) and that no legal impediments prevent them from practicing.
3Data Confidentiality & Restrictions
A Responsibility
Users agree to treat all Patient Data as strictly confidential. MedySoar presents data “As-Is” and makes no warranties regarding the accuracy of information entered by users.
B Prohibited Actions
Users shall not:
- Reverse engineer the platform.
- Build competitive products using MedySoar's proprietary structure.
- Use automated scrapers/robots to access data.
- Attempt to breach security measures.
Liability Clause: In case of a breach of security or proprietary provisions, the breaching party shall be liable for damages commensurate with the actual loss and injury sustained by the Company and its affected Users.
4De-Identified Data
“De-Identified Data” refers to information where personal identifiers have been removed. MedySoar owns all rights to De-Identified or aggregated data and may use it for research, analytics, clinical decision support improvement, and business operations without requiring additional consent.
5Termination & Disclaimers
MedySoar may terminate your access immediately if you fail to comply with these TOS. Upon discontinuation, we will make reasonable efforts to allow you to back up your Data in an electronic format.
DISCLAIMER: THE PLATFORM IS PROVIDED “AS IS”. MEDYSOAR DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. USE AT YOUR OWN RISK.
6Indemnification & Liability
You agree to indemnify and hold MedySoar harmless from claims arising from your misuse of the platform or violation of laws. To the fullest extent permitted by law, MedySoar's liability for any claim shall not exceed the fees paid by you in the three (3) months preceding the claim.
7Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi/NCR, India.
